Curry Has String of Success in Domestic Matters

Jill Curry’s growing family law practice saw quite an end to 2016. Between October of 2016 to the end of the year, Curry prevailed in three separate matters that proceeded to evidentiary hearings, securing excellent results for each client.

First, Curry prevailed on a Motion to Enforce Parenting Time in favor of her client, a mother who was struggling with the father of her young son’s constant noncompliance with their parenting schedule. The Court agreed with the mother’s position, and in addition to ordering the father to comply with the parenting schedule, and further ordering parenting education classes at father’s expense, the Court also ordered Father to pay all of Mother’s attorneys’ fees associated with the dispute.

Curry next prevailed on a request for a father to pay mother’s attorneys’ fees in an Allocation of Parental Rights and Responsibilities matter. While the parents ultimately agreed on the parenting issues on the eve of the hearing, mother was seeking reimbursement of attorneys’ fees due to the parties’ inequitable financial circumstances. The attorneys’ fees issue proceeding to hearing, and the Court ordered the father to pay for 1/3 of the mother’s attorneys’ fees and costs. This was a substantial relief for the young mother, who was the full-time caregiver for their infant daughter and a part-time student.

Finally, Curry represented a father seeking a modification of parenting time to finally enjoy equal parenting with his two young daughters. The mother opposed his request, and on the day of the hearing informed the judge and the father for the first time she was actually seeking a decrease in parenting time for the father. The Court found in favor of the father, modifying the parenting time to give him 50/50 parenting, and further denied mother’s request to modify holiday parenting agreements that had been in place since the underlying divorce. The modification is further likely to result in a decrease in father’s child support when that portion of the matter proceeds to hearing in April.
